IARC Course Terms and Conditions

(Courses Commencing From October 2007 Onwards)

PREAMBLE

A The terms and conditions set out below (‘Terms and Conditions’) form part of the agreement between a course applicant/ participant and the course provider, the Immigration Advice and Rights Centre (‘IARC’).

B The Terms and Conditions are in addition to those set out in the course registration form.

TERMS AND CONDITIONS

1 Registration Fee

1.1 The registration fee for the course is as advertised.

2 Registration and payment

2.1 To register in an IARC course, the applicant shall complete and submit to IARC a course registration form, together with the required registration fee.

2.2 IARC has an absolute discretion to accept or reject an application for registration in an IARC course.

2.3 As soon as is reasonably practicable following receipt of an application provided pursuant to clause 2.1 above, IARC shall:

a. Notify the applicant in writing that their application for registration has been accepted by IARC, at which point the applicant shall become a course participant (‘Participant’); or

b.Notify the applicant in writing that their application for registration has been rejected by IARC, and return the registration fee.

3 Withdrawals and Refunds

3.1 Notification of withdrawal from or deferral from the course following registration and payment under clause 2.1 above must be made in writing to IARC.

3.2 Refunds for withdrawal or deferral from the course will be dealt with as follows:

(a)

For withdrawals/deferrals notified to IARC 30 working days or more prior to scheduled commencement of course

70% of registration fee will be refunded

(b)

For withdrawals/deferrals notified to IARC less than 30 working days and more than 14 working days prior to scheduled commencement of course

50% of registration fee will be refunded

(c)

For withdrawals/deferrals notified to IARC 14 days or less prior to  scheduled commencement of course

No refund

(d)

For withdrawal/deferrals requests accompanied by nomination of a replacement person in accordance with  clause 3.3 below

No refund plus a $25 administration fee

3.3 An applicant may nominate a replacement person to attend the course in their place by providing:

a. a written notification that the course applicant is withdrawing from the course;

b. a written request that the course applicant nominates a replacement person to attend the course;

c. a registration form completed by the replacement person; and

d. a $25 administration fee.

A replacement person nominated pursuant to this clause 3.3 shall be subject to all terms and conditions set out in this document.

4 COURSE VARIATION BY IARC

4.1 Course details were correct at the time of printing.

4.2 IARC will make every effort to deliver the course as advertised, however, IARC reserves the right to amend the course details if required, or to cancel the course.

4.3 If IARC varies or cancels the course, the course applicant/ Participant shall be entitled to:

a. a refund in full of the course registration fee; or

b. transfer to another available IARC course. In the event that the course applicant seeks to transfer to a another available course, the difference in course registration fee shall be paid by/ or refunded to the course applicant, as applicable.

4.4 IARC shall not be liable for any other costs or losses incurred by the course applicant due to the variation or cancellation of the course.

4.5 IARC shall endeavor to inform all Participants of any variation or cancellation of the course  no later than 24 hours prior to the scheduled time of commencement of the course.

Accordingly, the course applicant/ participant must ensure that IARC is kept informed of the course applicant’s current contact details.

4.6 While IARC shall make every effort to inform Participants of any variation  or cancellation of the course details in accordance with clause 4.5 above, it is the course applicant’s/ Participant’s responsibility to contact IARC to confirm the details of the course.

5 CPD ATTENDANCE REQUIREMENTS

5.1 Where the IARC course is a Continuing Professional Development Activity (‘CPD Activity’), IARC shall notify the MARA that a Participant has successfully completed the CPD Activity only if the Participant has complied with all MARA attendance requirements, and has otherwise been considered by IARC to successfully complete a CPD Activity. 

5.2 CPD Participants are required to:

(a) Arrive at least 15 minutes prior to the scheduled CPD Activity commencement time;

(b) Sign their name and time of arrival on the form provided at the venue for the CPD Activity. This must be done prior to the scheduled time of commencement of the CPD Activity;

(c) Not leave the CPD Activity prior to the scheduled CPD Activity conclusion time;

(d) Not be absent from the CPD Activity for a cumulative duration of more than 10 minutes;

(e) Sign their name and time of departure on the form provided at the venue for the CPD Activity.

5.3 A failure by the Participant to comply with this clause 5 may result in the Participant failing to successfully complete a CPD Activity.

5.4 It is the sole responsibility of the Participant to ensure that the Participant complies with this clause 5.

5.5 IARC shall not be liable for any loss suffered by the Participant due to the failure of the Participant to comply with this clause 5.

6 NOTIFICATION OF SUCCESSFUL COMPLETION OF AN ACTIVITY

6.1 IARC shall notify the MARA that a Participant has successfully completed a CPD Activity only after:

(a) payment is received from the Participant by IARC; and

(b) the payment has been cleared or verified,

6.2 IARC shall not be liable for any loss flowing from the late payment by the Participant.

7 EXTRA COPY OF CERTIFICATE OF COMPLETION

7.1 IARC shall issue one copy of a certificate evidencing successful completion of a CPD Activity only if:

(a) an express request is made by the Participant to IARC;

(b) the Participant has complied with all relevant terms and conditions set out in this document;

(c) the Participant pays to IARC the administration fee of $10 per certificate.

7.2 IARC reserves the right to refuse any request for the issue of a certificate evidencing successful completion of a CPD Activity conducted 12 months or more prior to the date of the request.

8 ENGLISH PROFICIENCY

8.1 Participants in any IARC course are expected to be proficient in English.

9 PRIVACY AND PERSONAL INFORMATION

9.1 IARC collects personal information from you for the purpose of providing you with courses/ seminar/ information you have requested.

9.2 You can choose not to provide the personal information IARC requests, however this may result in IARC being unable to provide services or information to you.

9.3 IARC will not disclose your personal information to any third party unless required by law, required in order to comply with our funding obligations, or unless you consent.

9 COMPLAINTS

10.1 Complaints, comments or concerns regarding any aspect of these Terms and Conditions should be forwarded to IARC’s Education Coordinator.

10.2 In the event that you are not satisfied with the response of the Education Coordinator, you may forward your complaint, comment or concern to IARC’s Director/ Principal Solicitor.

10.3 Complaints, comments and concerns requiring response shall be responded to as soon as practicable.
